On Saturday, January 19, in force the laws on the right of universities to lease the premises on countering bullying and suspension of the bankruptcy of state-owned mines.
For example, in Ukraine came into force law No. 2661-VIII, which enables educational establishments to lease space to ensure the educational process or services students.
The law was adopted by Parliament on 20 December 2018.
The explanatory Memorandum States that the objects and the property of the state and municipal educational institutions are not subject to privatization or use for other than educational purpose. At the same time, according to technological requirements to ensure the establishment and conduct educational activities in higher education under the License terms of the educational activities of educational institutions, approved by the resolution of the Cabinet of Ministers, envisages the presence of the University of social infrastructure, including power points.
In addition, in accordance with paragraph 5 of article 29 of the law “On education”, the Supervisory (Board of Trustees), the Council of the educational institution may help attract additional sources of funding, and according to the provisions of article 79, the sources of financing of educational activity in accordance with legislation may be income from the sale of products of educational-production workshops, enterprises, shops and farms, from the lease of premises, facilities and equipment.
Also entered into force the law №2657-VIII on countering bullying. According to the text of the law, bullying would be considered the actions of the participants in the educational process, which consist of psychological, physical, economic, sexual violence, including by means of electronic communications, committed against a minor or of a minor or such person in relation to other participants in the educational process, which led to or could have caused harm to the mental or physical health of the victim.
Punishment for bullying would be a fine of from 850 to 1700 UAH or public works 20 to 40 hours. When harassment by a group of persons or in the case of repeated bullying during the year, the penalty is a fine from 1700 to 3400 UAH or public works for the term from 40 up to 60 hours.
In addition, a penalty is provided for the head of the institution of education, if he will not tell about the facts of bullying to law enforcement. Responsibility for the head of the institution provides for a fine of 850-1700 UAH or corrective works for the term up to one month with deduction of 20% of earnings.
In Ukraine came into force the law № 2658-VIII, which extends until January 1, 2022 , the suspension of the bankruptcy and the blocking of accounts of the state coal enterprises.
In the explanatory note stressed that in the event of failure of the proposed draft law on extending the provisions on temporary suspension of execution proceedings and measures of enforcement in respect of state coal mines prior to 1 January 2022 1 January 2019 “to expect a complete blockage of the state-owned coal enterprises that would jeopardize the existence of the public sector coal industry and weaken the energy security of Ukraine as a whole.”
The purpose of the document is to renew until 1 January 2022 transitional period necessary for the sustainable development of state-owned coal sector, implementation of the approved strategic technical re-equipment of mines and the improvement of their technical and economic indicators, and harmonization of provisions of some legal acts among themselves.
“The adoption of this bill will ensure further stable operation of the state coal enterprises to undertake upgrading of existing mines and to prevent ungrounded closure by the arrest of accounts and bankruptcy proceedings,” – said in the explanatory note.
