Protection of the accused asked to consider his actions self-defense.
The final hearing in the matter of beating a former participant ATO Mykola Stelmakh was held yesterday, July 16, in Zhovtnevy district court. About it reports “Aspirine”.
According to the source, during a debate at yesterday’s hearing, the prosecution described the Vitali Sinacola (accused) as the “Deliberate heavy injury” and “an Especially daring hooliganism with the use of the subject, pre-adapted for bodily injuries” – featured articles 121 and 296 of the Criminal code of Ukraine respectively. For the accused, the prosecution demanded severe punishment under these articles – 8 years in prison.
The victim’s lawyer novel chmarsky drew the court’s attention to the fact that the video surveillance cameras recorded the moment when even after hitting the bat on the head, from which Nikolai Stelmach fell and lost consciousness, Vitaly Sincov continued stabbing him.
But the defense of the accused has described his actions as exceeding the bounds of self-defense. Allegedly, the accused appealed to self-defense because of the surprise attack by the injured Nikolai Stelmakh.
“I ask the court to draw attention to the fact that the victim first attacked Sinacola, as evidenced by the video, and was in a state of alcoholic intoxication. Defendant admits the alleged claims within the self, repents, pleads guilty to the offence under article 124 in connection with serious consequences for the health of the victim”, – said Sergey Bogdan, the lawyer of the accused.
The verdict in this criminal case in the Zhovtnevy district court of Zaporozhye will be announced on Monday, July 20.
