In the parliamentary Assembly of the Council of Europe called on Poland to revise the judicial reform and justice.
This is stated in the published on 13 December, the draft resolution, which was based on a report approved by the monitoring Committee of PACE, reports the correspondent of UKRINFORM.
“Judicial reform and justice in Poland continue to significantly undermine and to destroy justice and the rule of law, so they should be revised in accordance with the recommendations of the Council of Europe”, – stated in the monitoring Committee of the PACE.
The draft document States that the judicial system in Poland is “vulnerable to political interference and attempts to bring it under political control of the Executive, contrary to the principles of democratic governance on the principle of the rule of law”.
The monitoring Committee called on the Polish authorities to review the entire package of judicial reform and to amend the corresponding legislation according to the recommendations of the Council of Europe.
This mode does not contain the safeguards of the proceedings against the judges in a certain period of time, which allows the Minister of justice to impose on them disciplinary sanctions through appointed the same Minister of the disciplinary staff. The Commission believes that it violates the right of judges of first instance to protection, undermines their independence and not shielded from political influences.
