Russia must immediately release Ukrainian sailors – the UN Tribunal

A permanent court created in accordance with the UN Convention on the law of the sea, satisfy a key demand of Ukraine in the case of temporary measures, which should be Russia. This is stated in the decision of the Tribunal, announced on Saturday in Hamburg, reports “European true”.

Key provisions of the document were read by the President of the Tribunal judge Park Jin Hyeon.

Among other things, the court ordered Russia to immediately release Ukrainian sailors and let them return to Ukraine.

“The court finds it necessary to demand that Russia immediately release three detained Ukrainian ships Nikopol, Berdyansk and Yana mouthpiece, 24 of the detained sailors, and let them return to Ukraine”, – said the Chairman of the Tribunal.

For this decision voted by 19 judges, against – only the Russian judge Kolodkin.

It should be noted that the official Russian representative was absent at the hearing; the Russian side also refused to provide materials for hearings, however, conventional law the UN is still bound by the decisions. In the absence of the representative of the Russian Federation, the court used the official position of Russia regarding the events near the Kerch Strait.

“We know that Russia has a different perspective on the events that took place on 25 November 2018”, – said the Chairman of the Tribunal.

In particular, the court stated that it found no evidence of the Russian version of a provocative military operation Ukraine. “A secret invasion of the Ukrainian sailors, on which Russia insists, it seems to the Tribunal highly unlikely,” – said in the decision.

The court also agreed that Ukraine has exhausted all opportunities to negotiate with Russia on the release of the sailors without going to court.
