In the European Union to change work rules for truckers and the companies for the carriage of goods. DW explains what is known about the innovations and how they will affect the Russian and Ukrainian drivers.
In the European Union want to improve work rules for truckers and companies for road transport of goods. The main purpose of the amendments is to protect competition within the EU and to improve the working conditions of drivers.
When changes will take is still unknown. While all three participants of the legislative process in the EU – the European Parliament, the EU Council and the European Commission has just formulated its position. And now they will have to negotiate to find common vision of the new rules for drivers and transport companies, which will operate throughout the European Union.
Conditions the rest of the drivers
The current rules provide that every trucker must have a minimum of 45 hours of rest after a maximum of six days of work. At the same time provides for the possibility of reduced rest: it shall not be less than 24 hours after six working days. But then, during the following weekly rest a driver must obtain compensation. Namely, to put 45 hours add the time that it was lacking the previous week.
This model change is not a plan, but a system of compensation want to do more flexible. The European Commission has proposed to allow once a month two reduced weekly rest in a row. During the following year, already unabbreviated of rest the driver should compensate for all unused time. The EU Council introduced a requirement that every four weeks the trucker must provide the opportunity to spend a week relaxing at home. But the European Parliament has added that it can be not only at home but anywhere you want the driver himself.
No less important is another possible improvement: in all three institutions insist that regular weekly rest cannot take place in the cab of the truck. And if a trucker takes him not at home, the transport company should pay for the night. In the European Parliament believe that the place of rest should be of high quality and take into account the sex of the driver. But the Council of the EU wants to weaken this requirement: they agree, the driver can rest in the cabin, but only if we are talking about the shortened vacation.
In addition, the mandatory want to do and create a sufficient number of safe Parking. Now, according to the European Commission around the EU is not enough 400 thousand of these Parking lots. However, the EU Council and the European Parliament have different views on whether or not to oblige the member States of the European Union to Finance their construction. For its part, the European Commission allocates funds from the EU budget (EUR 45 million in 2014-17).
Payment of the drivers ‘ work in another country
In the European Union now has a special system of sending workers abroad, but only within the EU. According to the system, their working conditions must comply with the rules of the home country, not one where they perform work. But there are limitations: the work must be short to meet the minimum requirements of the state, where people are de facto working. However, only a few EU countries apply these rules in respect of truckers.
The European Commission has proposed to introduce across the EU a General rule for drivers working abroad. So, the EC wants them to receive the higher payment for their work, if they work at least three days a month in the country with higher wages.
In this question there are considerable differences. And the EU Council and the European Parliament want the drivers made more money from the first day of work in the countries with higher salaries. This transit should not be subject to the system of secondment. Exceptions will be made for cases when, during the transit trips are two operations of loading/unloading: either one on the way there and one back, or both on the way home. This should help to ensure that the truck did not go empty on the way back.
Control over observance of rules
These rules, if adopted, will work only under condition of introduction in operation of new system of compliance control. Rely primarily on “smart” tachographs. Such devices are installed on the truck to record the speed, distance traveled, and what did the driver.
“Smart” tachographs called when they are equipped with satellite navigation systems. This will make it easy to monitor what the truck is and when it crossed the border, and where they spent loading and unloading. And the EU Council and the European Parliament want to make it compulsory equipping of all trucks “smart” tachographs. While there is no agreement about the timing of the start of the innovation. Likely some time in late 2023 or the end of 2024.
Will the changes to the Russian drivers?
Working conditions throughout the EU, drivers from Russia, Ukraine, Belarus, Kazakhstan and other countries regulated by European agreement concerning the work of crews of vehicles engaged in international road transport (AETR). Planned EU innovation on the rules of stay will not directly alter the AETR.
At the same time, the rules of secondment abroad of drivers will affect (not yet known exactly how ) and the Russian, Ukrainian, Belarusian truckers. The fact that the EU is the principle that drivers from the European Union may not use the worst conditions than drivers from third countries, in particular Russia, Ukraine, Belarus. In addition, the draft amendments States that “smart” tachographs will be mandatory for all international vehicles on the territory of the EU.
It should be noted that until now the adoption of all these changes progressed with great difficulties: their proposals the Commission made in may 2017. It is not known when it will begin consultations on this issue between the European Parliament, the EU Council and the European Commission. Some MEPs would like to do it in June. However, a more likely term – autumn, when will the European Parliament of the new convocation.
