The Dnipro appeal court on 1 November dismissed the appeals of suspects in the theft of pipes in especially large sizes by Dmitry Burmaka and Dmytro Dzubenko on the decision of the Industrial court on the extension to them of the detention. Until December 5, the accused will remain in jail.
We will remind, a criminal group which, according to the investigators, consists of 9 members, worked at the plant during the last two years. During this time the plant was illegally exported 1,700 tons of oil and gas pipes. The stolen pipes were sold through one of the companies – contractors of the company INTERPIPE. According to estimates from the economic security service of the Company, the total damage from theft amounted to 2 million USD.
In the night from 19 to 20 June the group was detained while trying to take out the next batch of pipes. And in October, militiamen and employees of security service of Interpipe opened a second channel of the theft of products from INTERPIPE NTRP.

But the defendants disagreed with this court’s decision and decided to appeal.
How did the court
Under the building of the Dnieper court of appeal came to the employees of the plant who are outraged by the behavior of the suspects – their refusal to cooperate to cooperate with the investigation and attempts to avoid punishment.

At the hearing, the lawyers continued to ask the court to change the content in jail-hour house arrest, saying their claims that their wards are not going to disappear, have strong social ties and children. When these arguments did not work, the lawyer Burmaka said about the bias of the judge of the Industrial court, extending the term of detention of his client and questioned whether it was properly complied with the secrets of the jury room, in which he took his decision.
In turn, the lawyer Dzyubenko suddenly decided that the Prosecutor is too much opposed to changing the measure of restraint and asked him not to worry and “not to tear the accordion.” Like, he knows Dzyubenko since childhood and warrants that on the outside he will behave. But no documents confirming necessity of change of a place of detention of the suspect, the counsel for the court and not given. Unlike the Prosecutor Novel Shestopalova, who asked to adduce the written testimony of a witness, who in the night of the theft, the defendants are ordered to ship the pipe. In the testimony the witness has expressed fear for his life and health if the detainees were released.
The prosecution also stated that after leaving the prison, the suspects will be able to create obstacles to the investigation and influence witnesses. This is evidenced by the fact that the detainees still do not cooperate and refuse to testify.
The Dnieper, the court of appeal took into account the Prosecutor’s arguments and upheld the decision of Industrial district court. The defendants will remain in jail until December 5.
Employee of the economic security service of INTERPIPE Alexander Zvagelsky shared his impressions of the hearing: “In my opinion the court clearly understood the arguments and make an informed decision. Suspects I repeat the same arguments, but added another – say one of their partners changed the measure of restraint, and for some reason they should be in jail. But our players are just trying to “put pressure on the pity”.
The investigation is continuing. At the end of November, according to forecasts of the Prosecutor it will be completed, and the case went to trial. If found guilty, the defendants could face from 7 to 12 years of imprisonment.
