Passengers are entitled to claim compensation in one country for a connecting flight, even if the delay was in another country with another airline.
This decision was made by the court of the European Union.
The case concerned the flight of British Airways from Hamburg to London and then another flight from London to Madrid and on to San Sebastian is Iberia. Flight Madrid-San Sebastian was cancelled.
Passengers asked for compensation to the company Iberia through a German Agency. However, the court of Hamburg wasn’t sure if he could consider the case because the delay occurred in Spain and the lawsuit was filed against the airline, which was not involved in transportation on the route Hamburg-London.
The EU court said that because the journey was booked on one ticket, “claims for compensation for the cancellation of the last stage of the journey can be transferred to the courts of the place of departure of the first stage of the journey, even if they are presented to the carrier responsible for the final stage”.
