The maximum punishment is deprivation of liberty for a term up to three years.
In the Lviv region four doctors from Borislav suspected of negligent performance of professional duties, which resulted in the death of 31-year-old mothers in 2018.
It is noted that on suspicion in Commission of crime under parts 1 and 2 of article 140 (improper performance of professional duties of medical or pharmaceutical worker which has entailed heavy consequences) the criminal code of Ukraine reported to the head of the surgical Department, two obstetrician-gynecologists and anesthesiologist KNP “Central city hospital in Borislav”.
Pre-trial investigation found that in September 2018 these persons were attracted to the treatment of genera and 31-year resident of Borislav, who has been admitted to hospital with a fourth pregnancy in the period 37-38 weeks.
According to investigators, the pregnant woman was in the hospital from 7 to 10 September and was sent home, where he was preparing for a planned caesarean plant; however, due to the urgent testimony of 14 September addressed to the maternity ward where the doctors during the consultation decided to conduct the operation. For the provision of anesthetic support was attracted by the duty anesthesiologist, who chose the type of anesthesia and began to prepare the equipment for surgery.
“The doctors started the operation of caesarean section, but after five unsuccessful attempts at intubation in women cardiac arrest. The operation was stopped and started to carry out resuscitation, in particular, intensive therapy. Shortly before the patient developed tonic-clonic seizures and the doctors called the head of surgery, who also could not perform a tracheotomy because of a “short neck, and technical challenges”, – stated in the message.
According to prosecutors, the woman’s condition was extremely severe, so the doctors called the Lviv emergency medicine specialists that performed a tracheotomy and freed from the trachea of mucus. After that, the woman hooked up to a ventilator.
“In the future, Lviv doctors operated on the woman, however, prolonged hypoxia and other complications permanently influenced the condition of the child and, as a consequence, led to disability. On the same day the woman was transported by ambulance to the intensive care unit of the Lviv regional clinical hospital, where she is 27 September 2018 died”, – added in Prosecutor’s office.
The maximum punishment provided by sanctions of articles – imprisonment for the term up to three years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to three years.
