The final version of the draft law on circulation of agricultural land provides for the prohibition for foreigners to buy land in the 50-kilometer border zone.
About it to UKRINFORM during a public discussion the final version of land reform “has changed the bill on the circulation of lands after the edits?” said the Chairman of the Verkhovna Rada Committee on agrarian issues and land policy Nikolay Solsky.
“Even if the referendum is not allowed to make a party to the transactions which are foreigners or legal persons founded by foreign nationals, with the agricultural lands in the zone of 50 km (from the state border – ed.),” said Solsky.
In addition, according to him, the acquisition of Ukrainian agricultural land is prohibited for legal entities, members of which are citizens of the aggressor state, or of another state if it is impossible to establish the ultimate beneficiary of such legal entities. Or if those beneficiaries are registered in offshore zones, are members of terrorist organizations, persons against whom personal sanctions are applied. Also can’t buy agricultural land in Ukraine, individuals and legal entities registered in States that do not cooperate in the sphere of counteraction to laundering of proceeds of crime.
The decision to prevent foreigners to the land market have been influenced by society.
“This decision (to the exclusion of foreigners to land market – ed.) is not a populist, but a compromise, and it is made not under pressure, and under the influence of public opinion,” said Solsky.
Present at the discussion the representative of the President on land issues Roman Leshchenko also said that the restriction of admission of foreigners to the Ukrainian market of agricultural land does not violate the investment obligations.
“The EU is our closest neighbors (e.g. Poland, Hungary) took the stage and they too had restrictions on foreigners,” he said.
It should be reminded that the Verkhovna Rada on 13 November 2019 adopted in the first reading the bill on amendments to some legislative acts of Ukraine on turnover of agricultural lands (No. 2178-10). The draft law provides for October 1, 2020, the lifting of the ban on the sale of land. According to the document, the persons who may acquire ownership of land for agricultural purposes, are citizens of Ukraine, territorial communities, the state, legal entities of Ukraine and foreign citizens and persons without citizenship in case of acquisition by inheritance and duty to exercise the alienation of land during the year.
Earlier, the President Zelensky said that the decision on the law of sale of agricultural land to foreigners will be taken only after a nationwide referendum.
28 Dec 2019 Committee on agrarian and land policy recommended the Parliament to adopt in the second reading the draft law on turnover of agricultural lands (No. 2178-10).
January 13, 2020 Chairman of the Verkhovna Rada Dmitry Razumkov noted that the bill number 2178-10 for today is not on the agenda.
