Several companies-owners of game machines have won the case against Ukraine at the European court of human rights (ECHR), seized nearly 500 thousand euros for moral damages for the revocation of the license without compensation. About this on his page in Facebook said the lawyer Elena Leshenko working with the courts.
“Company “TOV “Sweet rozvag” (Kharkiv), “Game-bet” (Lviv) and the citizen Stanko (Transcarpathia). In this case the European court acknowledged the violation of the right of ownership under article 1 of Protocol 1 to the Convention. The violation was deemed due to the fact that revoking licenses for gambling business, in connection with the entry into force of the new law, the government provided compensation to the claimants. The amount of compensation according to the decision of the European court – “LLC “Svit rozvag” – EUR300 thousand for material damage and legal costs EUR17 thousand citizen Stanko – EUR58. 5 thousand damage and EUR2. 2 thousand of legal costs, the company’s “Game-bet” – EUR135 thousand material damage and EUR214 costs”,- she wrote.
Leshenko also reported that another case against Ukraine was won by Turkish company “Cosmos Maritime Trading and Shipping Agency”.
“Turkish company “Cosmos Maritime Trading and Shipping Agency” won by paragraph 1 of article 6 of the Convention (right to fair trial; length of proceedings), and will receive compensation for moral damage – EUR10 million,” she wrote.
