The highest anti-corruption court (WACHS) explained why he canceled the arrest of the former Minister of income and fees Alexander Klimenko. In WACHS noted that Klimenko is not in the international wanted list.
This is stated in the comment of the judge-speaker of the Appeals chamber WAX Inna Kalugina, RBC-Ukraine online reports.
She noted that in absentia arrest of a suspect is possible only in the case of the announcement in the international search. In the opinion of the judges of the Appeals chamber WAX, it is a condition in Klimenko is missing.
In this June 10, 2019, the Prosecutor of the military Prosecutor issued a resolution declaring ex-Minister in the international search, but the court has not taken any action to implement it.
For example, the court found no evidence that the Prosecutor has addressed with the corresponding request on the wanted list of Interpol.
WAX also notes that the case Klimenko in November 2019 was transferred from the military Prosecutor’s office in NABU and SAP.
WAX emphasizes that the prosecution has the right to re-apply to the court with the petition for arrest Klimenko after the elimination of these disadvantages.
The Pechersky district court of Kiev in absentia arrested Klimenko in August 2019. In July the Prosecutor General’s office reported the completion of the in absentia proceedings against him and several entities.
Also RBC-Ukraine wrote that in 2019 there was a scandal when the only witness in this case, the entrepreneur Vladislav Draeger said that his testimony was fabricated according to the plan, supposedly agreed with the military Prosecutor Anatoly Matios.
